Terms of Service
1. Agreement to terms
These Terms of Service ("Terms") govern access to and use of COLLECTiT!, a digital evidence collection and case management platform operated by PROVE iT! Forensics ("COLLECTiT!," "we," "us"). By creating an account, accepting an invitation to join an organization's account, or otherwise using COLLECTiT!, you agree to these Terms on behalf of yourself and, if applicable, the organization you represent ("Customer").
2. The service
COLLECTiT! provides tools for collecting, preserving, and managing digital evidence for Customer's own investigations — including endpoint collection via installed agents, case management, chain-of-custody tracking, and evidence storage. Customer controls what devices are enrolled, what evidence is collected, and how cases are managed.
3. Business verification
Because COLLECTiT! is used to collect real evidence, new organizations go through a business verification step (via Stripe Identity) before activation. Customer agrees to provide accurate information during this process. We may suspend or decline an account that fails verification or that we reasonably believe was set up fraudulently.
4. Accounts & access
Accounts are organized around a Customer organization. The organization's admin(s) invite users and assign roles that control what each user can see and do. Customer is responsible for the accuracy of the information used to set up its account, for keeping login credentials confidential, and for all activity that occurs under its organization's account.
5. Subscriptions, billing & fees
- COLLECTiT! is offered on subscription plans (currently Starter, Professional, Business, and custom Enterprise terms), billed as described on our pricing page at the time of purchase.
- Fees are non-refundable except as required by law or as we otherwise state in writing.
- We may change pricing for future billing periods with reasonable advance notice.
6. Acceptable use
Customer agrees not to: use COLLECTiT! to collect evidence from a device or account it does not own or does not have proper authorization to investigate; attempt to gain unauthorized access to COLLECTiT! or another customer's data; reverse-engineer or resell COLLECTiT! except as expressly permitted; use COLLECTiT! to violate applicable law (including employee-monitoring and privacy laws in the jurisdictions where Customer operates); or interfere with the security or normal operation of the service. Customer is solely responsible for ensuring it has the legal right and internal authorization to collect evidence from any device, account, or individual before doing so.
7. Customer data & evidence integrity
As between the parties, Customer retains all rights to the evidence, case data, and records it collects through COLLECTiT!. Customer grants COLLECTiT! the limited right to process that data solely to provide the service. COLLECTiT! is designed to preserve evidence integrity (chain-of-custody logging, tamper-evident handling), but Customer remains responsible for how evidence is collected, used, and ultimately relied upon — including whether it is admissible for a particular purpose in a particular jurisdiction. See our Privacy Policy for how data is handled. On termination, Customer may request export or deletion of its data as described there, subject to any active legal hold.
8. Legal holds & disclosure requests
If COLLECTiT! receives a subpoena, court order, or other legal process seeking a Customer's data, our default is to notify Customer and direct the requester to Customer, unless we are legally prohibited from doing so. Customer is responsible for its own legal hold obligations and for preserving evidence as required by applicable law or litigation.
9. Service availability
We aim to keep COLLECTiT! reliably available but do not currently guarantee a specific uptime commitment outside of a signed enterprise agreement that states one. We'll make reasonable efforts to notify Customer of planned maintenance or known service issues that materially affect availability.
10. Intellectual property
COLLECTiT! and its underlying software, design, and branding are the property of PROVE iT! Forensics. These Terms do not grant Customer any rights to COLLECTiT!'s intellectual property beyond the right to use the service as intended. Customer retains ownership of its own evidence and case data.
11. Confidentiality
Each party agrees to protect the other's confidential information with reasonable care and to use it only as needed to perform under these Terms. This does not limit either party's ability to comply with legal obligations, including law enforcement requests made through proper legal process.
12. Disclaimer of warranties
COLLECTiT! is provided "as is" and "as available." While the platform is designed to help preserve evidence integrity, we do not warrant that evidence collected or preserved through COLLECTiT! will be deemed admissible or sufficient for any particular legal purpose — that depends on facts and law outside our control. To the extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.
13. Limitation of liability
To the extent permitted by law, COLLECTiT! and PROVE iT! Forensics will not be liable for indirect, incidental, special, or consequential damages, or for lost profits or lost data, arising from use of the service — including damages arising from evidence being deemed inadmissible, incomplete, or otherwise insufficient for Customer's purposes. Our total liability for any claim relating to COLLECTiT! will not exceed the amount Customer paid for the service in the twelve months before the claim arose.
14. Indemnification
Customer agrees to indemnify COLLECTiT! against claims arising from Customer's misuse of the service, violation of these Terms, violation of applicable law, or Customer's collection of evidence without proper authorization.
15. Term & termination
These Terms apply for as long as Customer has an active account. Either party may terminate a subscription as described in the applicable order or pricing terms. We may suspend or terminate access if Customer materially breaches these Terms and does not cure the breach after reasonable notice, fails business verification, or if required to prevent harm to COLLECTiT! or other customers.
16. Changes to these terms
We may update these Terms as COLLECTiT! evolves. We'll update the "Last updated" date above when we do, and for material changes we'll make a reasonable effort to notify account admins directly. Continued use after a change takes effect constitutes acceptance of the updated Terms.
17. Governing law
These Terms are governed by the laws of the jurisdiction in which PROVE iT! Forensics is organized, without regard to conflict-of-law principles, except where applicable law requires otherwise.
